Create The Writers Room Submission Terms and Conditions

The undersigned, as the authorized representative of the project named below (hereafter the "Project") submitted to Create The Writers Room (hereafter "CTWR"), hereby acknowledges that they have read, understood, and agreed to the following Terms and Conditions:

  1. Authority to Submit and Exhibit
    The undersigned represents and warrants that:
    (a) They are duly authorized, on behalf of themselves and all parties with any ownership, licensing, or other interest in the Project ("Project Owners"), to submit the Project to CTWR for consideration and to make all representations herein;
    (b) Submission, review, or potential exhibition of the Project by CTWR will not violate any law, right, or agreement of any third party;
    (c) The Project is free from any litigation, claim, arbitration, or dispute;
    (d) No future agreements will impair CTWR’s ability to exhibit, review, or otherwise use the Project in connection with its programming.

  2. Intellectual Property and Rights Clearance
    The undersigned represents that the Project’s exhibition, consideration, and any related activities by CTWR will not infringe any copyright, trademark, privacy, publicity, or other rights of any entity, and that all necessary permissions, clearances, and payments have been secured.

  3. No Fiduciary Relationship or Compensation
    Submission of the Project does not create any confidential, fiduciary, agency, or other special relationship between the undersigned or the Project Owners and CTWR.
    Selection or consideration does not imply endorsement. No compensation is owed by CTWR in connection with the submission, review, or exhibition of the Project.

  4. Indemnification
    The undersigned agrees to indemnify and hold harmless CTWR, its officers, directors, employees, agents, affiliates, advisors, and representatives (the "CTWR Related Parties") from any and all claims, damages, liabilities, fees, and expenses (including attorney fees) arising from the submission, exhibition, or use of the Project or any breach of these Terms.

  5. Voluntary Submission
    The Project is submitted voluntarily, without promise or inducement, and submission does not obligate CTWR to review, exhibit, or otherwise consider the Project, or to return any materials submitted.

  6. Waiver of Claims
    The undersigned, on behalf of themselves and the Project Owners, waives any claim against CTWR Related Parties arising from submission, review, non-selection, or any exhibition (or lack thereof) of the Project.
    If any such claim is brought, the undersigned agrees to indemnify CTWR Related Parties against any resulting damages or fees.

  7. Limitation of Remedies
    In the unlikely event a claim against CTWR Related Parties is permitted to proceed, the sole and maximum remedy shall be the refund of any submission fee paid. No other damages (including consequential, punitive, or injunctive relief) may be sought.

  8. Rights Granted Upon Acceptance
    If the Project is accepted:
    (a) CTWR may use excerpts, stills, titles, and information about the Project for promotional purposes;
    (b) CTWR may issue publicity and use the names, likenesses, and biographical information of Project personnel in connection with CTWR events, promotions, and marketing.

  9. Festival Benefits and Third-Party Agreements
    Any obligations between the undersigned and third parties regarding benefits (such as credits, tickets, or payments) remain the sole responsibility of the undersigned and Project Owners. CTWR bears no responsibility for administering or enforcing such obligations.

  10. No Guarantees
    CTWR makes no promises, representations, or guarantees regarding the consideration, selection, exhibition, or feedback on the Project.

  11. Digital Access and Security
    By submitting, the undersigned grants CTWR the right to access, view, and securely store all digital assets related to the Project for the duration of the selection process and programming cycle. CTWR takes reasonable precautions to protect submissions but is not liable for any unauthorized access, copying, or infringement.

  12. Consent for Minors
    If the undersigned is under the legal age of majority, a parent or legal guardian’s signed consent must accompany the submission.

  13. Governing Law and Arbitration
    Any disputes arising from or relating to these Terms, the Project, or its submission to CTWR shall be governed by California law and resolved exclusively through final and binding arbitration in Los Angeles, California, under JAMS Streamlined Arbitration Rules. No party shall be entitled to punitive damages. The prevailing party shall be entitled to reasonable attorneys’ fees and costs.
